- the basic obligation of the lessee is punctual payment of a rent
- the lessee is obliged to take care of the place and use it in accordance with the contract, to keep a proper technical and sanitary condition and obey housing order
- the lessee should keep unchanged condition of the place, he should not make any modifications without the lessor’s acceptance.
REMEMBER!
If you make any modifications that are not consistent with the contract, the lessor may notice the contract immediately.
- the lessee is obliged to do small repairs such as standard repairs of equipment or repairs of sockets.
- if the place has serious flaws, you may dissolute the contract or claim for a rent reduce. Your rights depend on the defects in the premises.. If the place has flaws that limit its usability (lack of hot water supply, no Internet access etc), you can claim for a rent reduce. If the place has flaws making using impossible (e.g. untight gas system), you have the right to dissolute the contract without a notice period.
REMEMBER!
You cannot claim for a rent reduce or dissolute a contract if you were aware of the faults at the moment of contract conclusion.
The obligation of income tax payment resulting from rent incomes applies only to the lessor. Costs related with tax obligations may be included in a rent, however a tax depends on total incomes. You should be aware of dishonest lessors that often do not pay that tax at all. If you think that a rent is excessive, ask the Lessor about the amount of a monthly tax resulting from rental and remind him about the obligation of tax payments. You may suggest that you are able to check in a tax office whether he pays this tax at such amount or even pays it at all.
Lessor obligations
At the moment of premises commission, the lessor is obliged to provide a premise in a state specified in a contract. The lessor is also obliged for serious repairs as repairs of electric or gas systems etc., providing that damages are not caused by the lessee.
