The natural person which wants to set up a business must submit the relevant application for the entry to the business activity register in the commune office (form EDG- 1).
One should submit it personally or by the registered letter, in the latter case, the petitioner’s signature must be certified by a notary (the notarial fee of certifying the signature on the document amounts to 20 PLN).
It is possible to fill in the form in the electronic version, which is available on the Ministry of Economy website. In case you do not have an electronic signature (safe electronic signature which was submitted within the period of the classified certificate), the application will have to be signed in person at the commune office on the specified date. The certificate is being issued by the entity providing certification services, and the period of its validity can amount up to two years. The register of classified subjects providing certification services is available on the website of the National Centre of Certification.
Foreigners do not have to fill in the columns concerning the PESEL number (it is a unique symbol identifying the natural person in the Electronic System of Population Register) and the Number of the Tax Identification [NIP], if they do not have them.
An entrepreneur can start business from the moment of filing in the appropriately signed application. One does not have to wait for receiving the certified excerpt from the register.
According to the so-called „one window” principle the commune authority will send the entrepreneur’s application to the competent revenue office to fill an application for tax purposes, to the competent statistical office to grant the entrepreneur the REGON number (statistical number of the business entity in the Domestic Official Register of Subjects of the National Economy) and will submit the application to the Social Insurance Agency. The entrepreneur is not making additional actions in person.
Foreigners belonging to the group of citizens of other countries than the EU Citizens, but having the status specified by the regulations of the Act on freedom of business activity, submit the application together with the document confirming their status, in particular the date of issue and the signature of the document indicating the organ which issued it, or submit the original of the document for inspection at the commune office.
The application for the entry into the records will be recognized positively, if:
- the document was submitted by the authorized person,
- the document is correct.
The submission of an application and issuing the entry certificate are liable to no fees.
