If the agency mediates the purchase of the property, it is its duty to inform you about the legal status of the property. Otherwise, you should check the legal status of housing in the Faculty of Land Registry at the District Courts. Land registration consists of 4 parts:
- section one - property in real terms; its location according to the building plan, type of construction, real estate assignment, property rights established in favour of the property;
- section two - property owners as well as potential perpetual users are inscribed;
- section three - records of rights in rem in immovable property except the mortgage. In addition, restrictions on disposing of property are also included;
- section four - mortgages inscriptions.
Once you have set the legal status of real estate (among others, whether it is not indebted to the mortgage payment), you can sign a preliminary contract and pay a deposit or advance payment.
ATTENTION! The bank will not give a mortgage loan, if property rights and mortgages are unknown.
What to look at in the preliminary contract?
Now you go to the bank, where you had made preparation to take a loan.
If you have the full sum of money to buy property you sign a contract of sale / purchase at the notary/. Drawing up a contract is chargeable. Maximum notary fees are fixed by the Regulation of the Minister of Justice of June 28th, 2004 on the maximum rates of notarial fee
