Foreigners must obtain the Ministry of Interior’s permission to purchase real estate in Poland. Request for authorization to purchase property in Poland always concerns a specific property!
Application for the real estate purchase in Poland by a foreigner must be drawn up in accordance to the information contained in the Act of March 24th, 1920 on the purchase of property by foreigners – see: Law of February 20th, 2004 amending the Act on the property purchase by foreigners and the Law on stamp duty (Journal of Laws 2004, No. 49, item. 466)
and the Regulation of the Minister of Internal Affairs and Administration April 26th, 2004 on detailed information and documentation that is required to be submitted by a foreigner applying for a permit for the real estate purchase (Journal of Laws 2004, No. 94, item. 925, with amendments)
Specific information required to obtain a permit:
The Ministry of Interior issues a permit at the request of an alien if:
- acquisition of property by a foreigner does not cause a threat to state security or public order and considerations of social policy and public health are not precluded,
- the alien demonstrates ties to the Republic of Poland.
In accordance to the article 1a. paragraph 2 of this Act, the circumstances showing the alien's ties to the Republic of Poland might be in particular:
- Polish nationality or Polish origin,
- marriage to a citizen of the Republic of Poland,
- residence permit for a fixed period, settlement permit or EU long-term resident permit,
- membership in the management companies listed in the Articles. 1. paragraph 2, point 4,
- performing the agricultural or economic activities on the territory of Poland according to the Polish law.
